OFFICIAL RULES

NO PURCHASE NECESSARY TO ENTER OR WIN A PRIZE. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING. VOID IN PUERTO RICO, AND WHERE PROHIBITED OR RESTRICTED BY LAW.

ELIGIBILITY

Ultimate Outdoor Adventure Sweepstakes presented by Auto Value®/Bumper to Bumper® (“Sweepstakes”) is offered only in the United States and Canada and is open only to persons who are legal residents of the United States and Canada who have reached the age of 21 years and who are employed in the automotive aftermarket as repair technicians who purchase or use auto parts in order to repair customer vehicles.

ENTRY PERIOD

Sweepstakes begins at 12:01 AM Central Standard Time (CST), March 1, 2026, and ends at 11:59 PM Central Daylight Time (CDT), April 30, 2026 ("Sweepstakes Period"). For purposes of these official rules, all times listed refer to Central Daylight Time or Central Standard Time, depending upon the time of the year.

HOW TO ENTER

NO PURCHASE NECESSARY. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING.

TO ENTER THE SWEEPSTAKES

There are three ways to enter the Sweepstakes:

A. Complete the Official Entry Form online at https://www.theultimateoutdooradventure.com. Enter the serial number from the official entry card provided with each purchase order over $150.00 USD or CDN. One entry is awarded for each such purchase.

B. Users of Auto Value/Bumper to Bumper’s on-line parts purchasing tool MyPlace4Parts® can click on the Official Entry Form that appears with each purchase of over $150.00 USD or CDN. They will automatically receive one entry for each such purchase, and an additional entry for each additional increment of $150 in daily purchases.

C. Send a 3x5 card with the following information: Technician Name, Email, Home/Street Address, City, State, Zip, Store/Shop Name, Store/Shop Address, City, State, Zip, Store/Shop Phone to:

All entrants must provide a street address. Entries providing only a post office box will not be accepted.

All Sweepstakes entries must be based on orders placed via MyPlace4Parts® on or before April 30, 2026, or 3X5 cards postmarked on or before April 30, 2026. All Sweepstakes entries must be received by May 15, 2026, at 11:59 PM CST. Any other attempted form of entry is prohibited.

DISCLAIMER

Aftermarket Auto Parts Alliance, Inc. (“Sponsor”), and all warehouse distributors, jobbers, and other vendors associated with the Sponsor in promoting and/or administering the Sweepstakes (the Sponsor and such other associated entities, being collectively called the “Sweepstakes Entities”) are not responsible for lost, interrupted, late or damaged mail, unauthorized human intervention, or other errors of any kind, whether human, mechanical, or electronic; including without limitation incorrect or incomplete Sweepstakes information (including Sweepstakes entry information) regardless of cause.

Entry materials that have been tampered with or altered are void. Use of robotic, automated, programmed, or like means to enter the Sweepstakes will void all entries affected by such methods. Sponsor reserves the right, at its sole discretion, to disqualify any individual it finds, in its sole discretion, to be tampering with the Sweepstakes entry process or the operation of the Sweepstakes. Once submitted, all requests and entries become the sole property of Sponsor and will not be acknowledged.

PERSONAL INFORMATION

By completing the Official Entry form, all entrants consent to the collection, use and distribution of their personal information by the Sponsor for the purposes of running the Sweepstakes and as permitted by these rules. Personal information is defined as anything that identifies an entrant as an individual, such as home telephone number, age, home address, email address, and gender. Sponsor will not sell or transmit this information to third parties except for the purposes of administering this Sweepstakes.

DRAWINGS

Winners will be selected by two (2) random drawings from all eligible entries received by 11:59 PM Central the day prior to each drawing date. The drawings will be conducted by the Sponsor. The drawings for the Sweepstakes will be conducted on April 1, 2026 (Drawing 1), and May 15, 2026 (Drawing 2). All entries not selected as Winners from the first drawing will be included in the second drawing in this Sweepstakes.

SKILL-TESTING QUESTION (CANADIAN RESIDENTS ONLY)

Upon notification of selection for a Ultimate Outdoor Adventure Sweepstakes Grand Prize, if the selected entrant is a Canadian resident, he or she must correctly answer a time-limited mathematical skill-testing question without assistance of any kind, whether mechanical or otherwise, before the prize will be awarded. In the event that the selected entrant is unable to answer the skill-testing question correctly, the Sponsor shall have the right to disqualify said entrant and to randomly draw another eligible entry, and the Sponsor shall be fully and completely released and discharged from any liability or responsibility in this regard.

PRIZES, APPROXIMATE RETAIL VALUE (ARV)

GRAND PRIZE: Total of twenty (20) Grand Prize Trip Winners (as defined below) will win an Ultimate Outdoor Adventure Sweepstakes Trip package. Ten (10) Grand Prize Trip Winners will be selected in Drawing 1. Ten (10) Grand Prize Trip Winners will be selected in Drawing 2. The approximate retail value of the Trip is $7,500.00 USD.

FIRST PRIZE: Total of ten (10) First Prize Winners will each win a VISA Gift card valued at $500 USD. Five (5) First Prize Winners will be selected in each Drawing.

SECOND PRIZE: Total of forty (40) Second Prize Winners will each win a VISA Gift card valued at $250 USD. Twenty (20) Second Prize Winners will be selected in each Drawing.

THIRD PRIZE: Total of one hundred (100) Third Prize Winners will each win a VISA Gift card valued at $100 USD. Fifty (50) Third Prize Winners will be selected each Drawing.

Prizes are not allocated on a regional basis. The ARVs are subject to change based on current market conditions at time of prize fulfillment and the time of travel and the distance between departure and destination. Any difference between the ARVs and the actual values, if any, will not be awarded.

The Prizes will be awarded provided a sufficient number of eligible entries are received. Prize is nontransferable; no substitutions or cash redemptions except by Sponsor due to prize unavailability, in which case a prize of equal or greater retail value will be awarded. Winners will be required to execute and return a Statement of Eligibility and Liability and Publicity Release (unless prohibited by law) within 14 days of notification attempt or the prize may be forfeited, and an alternate winner selected in a random drawing from among all the remaining eligible entries. The electronic signature on the Statement of Eligibility and Liability and Publicity Release will be the legal equivalent of the manual signature of each winner.

Each Prize winner will be required to supply Sponsor with his/her social security number for tax purposes. Taxes (if any) on prizes are the sole responsibility of the winner. Prizes are nontransferable and cannot be assigned. Sponsor may, at its sole discretion, substitute a prize of equal or greater value if advertised prize becomes unavailable for any reason. Odds of winning a Prize depend on the total number of eligible entries received at the time of draw.

GRAND PRIZE TRIP WINNERS:

Twenty (20) Grand Prize Trip winners will win a Sweepstakes Trip package (referred to as “Trip”) provided by Sponsor. A Trip will be provided to the grand prize trip winner and his/her one (1) guest, who have both (Grand Prize Trip Winner and Guest, as defined below) reached 21 years of age at the time of the Trip, to Big Cedar Lodge in Ridgedale, Missouri (the “Destination”). The winner of the Grand Prize Trip is referred to as the “Grand Prize Trip Winner” and his/her guest as “Guest”.

The Trip consists of round-trip coach airfare for two (2) people, 5 nights of hotel accommodations (one-room cabin and room tax designated by Sponsor); selected activities and participation in meals and activities hosted by Sponsor.

Grand Prize Trip Winner and Guest will be solely responsible for any and all meals, beverages, ground transfers between winner’s residence and airport of departure, gratuities, travel upgrades, personal incidentals and any other expenses not specified herein. Sponsor reserves the right to substitute ground transportation in lieu of air transportation if the Grand Prize Trip Winner resides within 100 miles of Destination. Grand Prize Trip Winner and Guest must travel on same itinerary. Grand Prize Trip Winner and Guest will be responsible for obtaining valid U.S. government identification and/or other required travel documents (as applicable) prior to travel and the associated costs for these and other requirements. The Grand Prize Trip will be awarded provided a sufficient number of eligible entries are received. Grand Prize Trip is nontransferable; no substitutions or cash redemptions except by Sponsor due to prize unavailability, in which case a prize of equal or greater retail value will be awarded. Grand Prize Trip Winner will be required to execute and return a Statement of Eligibility and Liability and Publicity Release (unless prohibited by law) and Guest must execute and return a Liability and Publicity Release (unless prohibited by law) within 14 days of notification attempt or the prize may be forfeited and an alternate winner selected in a random drawing from among all of the remaining eligible entries. Sweepstakes Entities shall not be responsible for any cancellations, delays, diversions or substitutions or any act or omissions whatsoever by the air carriers, hotels or other transportation companies or any other persons providing any of these services and accommodations to passengers including any results thereof such as changes in services or accommodations necessitated by same. Sweepstakes Entities shall not be liable for any loss or damage to baggage. If either Grand Prize Trip Winner or Guest becomes disabled or cannot otherwise fully enjoy the Trip package due to illness, Sponsor shall have the option at its sole discretion of: (1) being relieved of liability for fulfillment of the prize award; or (2) extending the period during which such prize may be awarded for a period determined in the sole discretion of Sponsor. Grand Prize Trip Winner or Guest must prove such disability by a doctor’s certificate, which certificate shall be endorsed by another physician agreeable to Sponsor and Grand Prize Trip Winner at Grand Prize Trip Winner’s expense. If a Grand Prize Trip Winner chooses not to take any Guest, or if any Guest does not sign the documentation as provided in these Official Rules within the time frame specified, then the Guest elements of the Grand Prize Trip will be forfeited, and the other elements of the Grand Prize Trip shall constitute full satisfaction of Sponsor’s obligation to award the Grand Prize Trip. Grand Prize Trip Winner and Guest agree to comply with all venue rules and regulations and agree not to act in an unsportsmanlike or disruptive manner.

Sponsor will determine in its sole discretion the airline and hotel to be provided as part of the Grand Prize Trip. All travel dates are subject to change in Sponsor’s sole discretion. If a Grand Prize Trip Winner or any Guest are not available or able to travel on the dates specified by Sponsor, Grand Prize Trip Winner and Guest’s privileges will be terminated and an alternative Grand Prize Trip Winner will be selected at random from the remaining eligible entries if time permits. Travel restrictions, conditions and limitations may apply. Travel arrangements are subject to availability and must be roundtrip.

Grand Prize Trip Winner and Guest acknowledge that they will be required to sign a waiver and assumption of risk regarding their participation in the Trip. By accepting the Trip, Grand Prize Trip Winner and Guest hereby release and covenant not to sue all Sweepstakes Entities for any personal property damage or personal injuries that may occur to either of them as a result of participating in the Trip. NOTE: The Grand Prize only includes the Grand Prize Trip Winner and one (1) Guest. No other guests of the Grand Prize Trip Winner are included. If Grand Prize Trip Winner chooses to bring any other guests on the Trip, such guests shall not be the responsibility of Sponsor and none of the expenses of such guests will be paid by Sponsor. Further, Grand Prize Trip Winner acknowledges and agrees that any all indemnity covenants provided by the Grand Prize Trip Winner to Sponsor, the other Sweepstakes Entities, the respective companies, affiliates, subsidiaries, advertising/promotional agencies, and the employees, officers, directors, and agents of any of the above organizations in these Official Rules or in any other documents or agreements provided by the Grand Prize Trip Winner to the Sponsor shall also apply to any such extra guests, the same as if they were the Grand Prize Trip Winner or the Guest.

APPROXIMATE RETAIL VALUE OF ALL PRIZES:

As stated above.

EXCLUSION FROM ELIGIBILITY

Employees (other than those employed by licensees of the Alliance as repair technicians), officers, and directors of Aftermarket Auto Parts Alliance, Inc., its respective affiliates, subsidiaries, advertising/promotional agencies, the other Sweepstakes Entities, and the members of the immediate family of any of the foregoing (parents, siblings, children, and spouse) or those persons living in the same household, whether related or not, of such individuals are ineligible to enter the Sweepstakes.

CONDITIONS OF PARTICIPATION

By entering, entrant has confirmed and is held accountable that the address on their entry is current and is valid for the Sweepstakes Period and for six months after the Sweepstakes has ended. The entrant's address must be a street address. Entries showing post office boxes will not be accepted. Any prizes shipped to a wrong address or unclaimed will be forfeited and winner will become disqualified. The eligibility of each prize winner will be verified by the member of the Sponsor who made the sweepstakes available to such winner. Upon verification, the prize will be shipped to such member of the Sponsor. Such member will then notify the winner by telephone, e-mail or mail and will make arrangements for the delivery of the prize to the winner. Winners will be notified. If prize is returned as undeliverable, the winner of such prize will be disqualified, and an alternate winner selected in a random manner from among the remaining eligible entries. Each prize winner will be required to execute and return a Declaration of Eligibility and Liability and Publicity Release (unless prohibited by law) within 14 days of notification attempt or the prize may be forfeited, and an alternate winner selected in a random drawing from among all of the remaining eligible entries.

By entering in the Sweepstakes, entrant: (a) agrees to be bound by these Official Rules and by the interpretations of these Official Rules by Sponsor and by the decisions of Sponsor; (b) acknowledges compliance with these Official Rules; (c) agrees to comply with any and all applicable federal, state, and local laws, rules and regulations; (d) acknowledges the inherent hazards and risks associated with the use of go carts, golf carts, and other such vehicles, including sever injury and even loss of life and freely accepts and expressly assumes all risk, dangers and hazards that may arise from operation of a powersport vehicle which could result in personal injury, loss of life and property damage; and (e) forever releases, absolves, indemnifies and agrees to hold harmless Aftermarket Auto Parts Alliance, Inc., the other Sweepstakes Entities, the respective companies, affiliates, subsidiaries, advertising/promotional agencies, and the employees, officers, directors, and agents of any of the above organizations from any and all liability for any injuries, losses, or damages to person (including death) and/or property of any kind caused in whole or in part, directly or indirectly, by participation in the Sweepstakes or the acceptance, possession, or use/misuse of the prize or participation in any prize-related activities, and for any claim, demand, or cause of action known or unknown, suspected or unsuspected, past, present or future, to the maximum extent permitted by law without exception or reservation, including claims based on defamation, publicity rights, invasion of privacy, copyright infringement, trademark infringement, or any other intellectual property related cause of action. By accepting a prize, winner grants the right to Sponsor to record, videotape, and photograph such winner (“Images”). These Images will be owned by Sponsor. Sponsor and each of its designees shall have the right to use, edit, adapt, post, stream, copy, and exploit such Images, and all elements embodied therein, including any names, likenesses, voice, conversation, and any other attributes of such winner, individually or with others, together with his/her name, address, as well as any statements made by such winner regarding the Sweepstakes or Sponsor (provided they are true) in whole or in part, in conjunction with other material, if any, in any and all media now known or hereafter devised, for the purpose of trade, advertising, promotion, or any other lawful purpose whatsoever, in perpetuity, throughout the world, without additional compensation, consideration, notification, or permission, except where prohibited by law.

GENERAL TERMS

The Sweepstakes Entities are not responsible if the Sweepstakes or any of the events featured in the Sweepstakes cannot take place, or if any prize cannot be awarded due to delays, interruptions, or failures due to acts of God, war, natural disasters, weather, acts or threats of terrorism, strikes, lockouts, labor disputes, work stoppages, fire, acts of government, disease, or other events outside of the reasonable control of the Sweepstakes Entities. If, for any reason the Sweepstakes is not capable of running as planned, including, without limitation, infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the reasonable control of the Sweepstakes Entities, which, in Sponsor’s sole determination, corrupts or affects the administration, security, fairness, integrity, or proper conduct of the Sweepstakes, Sponsor reserves the right, in its sole discretion, to cancel, terminate, modify, or suspend the Sweepstakes or any part of the Sweepstakes. If the Sweepstakes or any part of the Sweepstakes is terminated or modified prior to the closing date of the Sweepstakes, notice will be posted on https://www.theultimateoutdooradventure.com if time permits and the prizes will be awarded to potential winners to be selected in a random drawing from among all of the remaining uncorrupted eligible entries received prior to any such event outside of the reasonable control of Sponsor. Sponsor reserves the right to modify and amend these Official Rules from time to time during the Sweepstakes for clarification purposes.

ANY VIOLATION OF THESE OFFICIAL RULES BY A WINNER WILL RESULT IN SUCH WINNER’S DISQUALIFICATION AS A WINNER OF THE SWEEPSTAKES AND ALL PRIVILEGES AS A WINNER WILL BE IMMEDIATELY TERMINATED.

ANY ATTEMPT BY ANY PERSON TO DELIBERATELY DAMAGE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAW AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK REMEDIES AND DAMAGES (INCLUDING ATTORNEYS’ FEES) FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW. THE COURTS (STATE AND FEDERAL) LOCATED WITHIN BEXAR COUNTY, TEXAS SHALL HAVE SOLE JURISDICTION OF ANY CONTROVERSIES REGARDING THE SWEEPSTAKES AND THE LAWS OF THE STATE OF TEXAS SHALL GOVERN THE SWEEPSTAKES. EACH ENTRANT WAIVES ANY AND ALL OBJECTIONS TO JURISDICTION AND VENUE IN THESE COURTS AND HEREBY SUBMITS TO THE JURISDICTION OF THESE COURTS.

QUEBEC’S RESIDENTS

Any litigation respecting the conduct or organization of this publicity contest may be submitted to the Régie des alcools, des courses et des jeux for a ruling. Any litigation respecting the awarding of a prize may be submitted to the board only for the purpose of helping the parties reach a settlement.

ELEGIBILIDAD

El Sorteo Aventura Definitiva al Aire Libre, presentado por Auto Value®/Bumper to Bumper® (el “Sorteo”), se ofrece únicamente en los Estados Unidos y Canadá y está abierto solo a personas que sean residentes legales de los Estados Unidos y Canadá, que hayan cumplido 21 años de edad y que estén empleadas en el mercado de posventa automotriz como técnicos de reparación que compran o utilizan autopartes para reparar vehículos de clientes.

Aftermarket Auto Parts Alliance, Inc. El uso de medios robóticos, automatizados, programados o similares para participar en el Sorteo anulará todas las inscripciones afectadas por dichos métodos. INFORMACIÓN PERSONAL

Al completar el Formulario de Inscripción Oficial, todos los participantes consienten la recopilación, el uso y la distribución de su información personal por parte del Patrocinador con el fin de administrar el Sorteo y según lo permitido por estas reglas.

Se entiende por información personal cualquier dato que identifique a un participante como individuo, como número de teléfono particular, edad, dirección de domicilio, correo electrónico y género. El Patrocinador no venderá ni transmitirá esta información a terceros, excepto para los fines de administrar este Sorteo.

SORTEOS

Los ganadores serán seleccionados mediante dos (2) sorteos aleatorios de todas las inscripciones elegibles recibidas hasta las 11:59 p. m., hora central, del día anterior a cada fecha de sorteo. Los sorteos serán realizados por el Patrocinador.

Los sorteos del Sorteo se llevarán a cabo el 1 de abril de 2026 (Sorteo 1) y el 15 de mayo de 2026 (Sorteo 2). Todas las inscripciones no seleccionadas como ganadoras en el primer sorteo serán incluidas en el segundo sorteo de este Sorteo.

PREGUNTA DE HABILIDAD (SOLO PARA RESIDENTES CANADIENSES)

Al ser notificado como seleccionado para el Gran Premio del Sorteo Ultimate Outdoor Adventure, si el participante seleccionado es residente canadiense, deberá responder correctamente una pregunta matemática de habilidad con límite de tiempo, sin ningún tipo de asistencia, ya sea mecánica o de cualquier otra forma, antes de que se le otorgue el premio.

En caso de que el participante seleccionado no pueda responder correctamente la pregunta de habilidad, el Patrocinador tendrá el derecho de descalificar a dicho participante y seleccionar al azar otra inscripción elegible, quedando el Patrocinador total y completamente liberado de cualquier responsabilidad al respecto.

PREMIOS, VALOR DE VENTA AL PUBLICO APROXIMADO (ARV)

GRAN PREMIO: Un total de veinte (20) Ganadores del Gran Premio del Viaje (según se define a continuación) ganarán un paquete de viaje del Sorteo Ultimate Outdoor Adventure. Diez (10) Ganadores del Gran Premio del Viaje serán seleccionados en el Sorteo 1. Diez (10) Ganadores del Gran Premio del Viaje serán seleccionados en el Sorteo 2. El valor aproximado de venta al público del viaje es de $7,500.00 USD.

 

PRIMER PREMIO: Un total de diez (10) Ganadores del Primer Premio recibirán cada uno una tarjeta de regalo VISA con un valor de $500 USD. Cinco (5) Ganadores del Primer Premio serán seleccionados en cada Sorteo.

 

SEGUNDO PREMIO: Un total de cuarenta (40) Ganadores del Segundo Premio recibirán cada uno una tarjeta de regalo VISA con un valor de $250 USD. Veinte (20) Ganadores del Segundo Premio serán seleccionados en cada Sorteo.

Los premios no se asignan por región. Los valores aproximados de venta al público (ARV, por sus siglas en inglés) están sujetos a cambios según las condiciones del mercado al momento de entregar el premio, el momento del viaje y la distancia entre el lugar de salida y el destino. El premio no es transferible; no se permiten sustituciones ni canje por dinero en efectivo, salvo que el Patrocinador lo haga debido a indisponibilidad del premio, en cuyo caso se otorgará un premio de valor igual o superior al original. Los ganadores deberán firmar y devolver una Declaración de Elegibilidad y Liberación de Responsabilidad y Publicidad (a menos que la ley lo prohíba) dentro de los 14 días posteriores al intento de notificación, de lo contrario, el premio podría perderse y se seleccionará un ganador alternativo mediante sorteo aleatorio entre todas las inscripciones elegibles restantes.

Cada ganador del premio deberá proporcionar al Patrocinador su número de seguro social para fines fiscales. Los impuestos (si los hubiera) sobre los premios son responsabilidad exclusiva del ganador. GANADORES DEL GRAN PREMIO DEL VIAJE:

Veinte (20) ganadores del Gran Premio del Viaje recibirán un paquete de viaje del Sorteo (denominado “Viaje”) proporcionado por el Patrocinador.

El Viaje será otorgado al ganador del Gran Premio del Viaje y a un (1) acompañante, quienes deben tener ambos 21 años o más al momento del viaje (el Ganador del Gran Premio del Viaje y el Acompañante, según se definen a continuación), con destino a Big Cedar Lodge en Ridgedale, Missouri (el “Destino”).

El ganador del Gran Premio del Viaje se denomina “Ganador del Gran Premio del Viaje” y su acompañante se denomina “Acompañante”.

El Viaje consiste en:

  • Boletos de avión ida y vuelta en clase económica para dos (2) personas,
  • 5 noches de alojamiento en hotel (cabaña de una habitación y los impuestos correspondientes designados por el Patrocinador),
  • Actividades seleccionadas y participación en comidas y actividades organizadas por el Patrocinador.

El Ganador del Gran Premio del Viaje y su Acompañante serán única y completamente responsables de cualquier gasto relacionado con comidas, bebidas, traslados terrestres entre la residencia del ganador y el aeropuerto de salida, propinas, mejoras de viaje, gastos personales y cualquier otro gasto no especificado en estas reglas.

El Patrocinador se reserva el derecho de sustituir el transporte aéreo por transporte terrestre si el Ganador del Gran Premio del Viaje reside a menos de 100 millas del Destino. El Ganador del Gran Premio del Viaje y su Acompañante deben viajar en el mismo itinerario.

El Gran Premio del Viaje se otorgará si se recibe un número suficiente de inscripciones elegibles. El premio no es transferible, y no se permiten sustituciones ni canje por dinero en efectivo, salvo que el Patrocinador lo haga debido a indisponibilidad del premio, en cuyo caso se otorgará un premio de valor igual o mayor.

El Ganador del Gran Premio del Viaje deberá firmar y devolver una Declaración de Elegibilidad y Liberación de Responsabilidad y Publicidad (a menos que la ley lo prohíba) y el Acompañante deberá firmar y devolver una Liberación de Responsabilidad y Publicidad (a menos que la ley lo prohíba) dentro de los 14 días posteriores al intento de notificación, de lo contrario, el premio podría perderse y se seleccionará un ganador alternativo mediante sorteo aleatorio entre todas las inscripciones elegibles restantes.

Las Entidades del Sorteo no serán responsables por cancelaciones, retrasos, desvíos, sustituciones ni por actos u omisiones de las aerolíneas, hoteles, empresas de transporte u otras personas que proporcionen estos servicios y alojamientos a los pasajeros, incluyendo cualquier cambio en los servicios o alojamientos que resulte de lo anterior. Las Entidades del Sorteo tampoco serán responsables por pérdida o daño del equipaje.

Si el Ganador del Gran Premio del Viaje o su Acompañante se incapacita o no puede disfrutar completamente del paquete del viaje debido a enfermedad, el Patrocinador tendrá la opción, a su entera discreción, de:

  1. Liberarse de cualquier responsabilidad por el otorgamiento del premio; o
  2. Extender el período durante el cual el premio puede ser otorgado, por un tiempo determinado a la entera discreción del Patrocinador.

El Ganador del Gran Premio del Viaje o su Acompañante deberán probar dicha incapacidad mediante un certificado médico, el cual deberá ser avalado por otro médico aceptable tanto para el Patrocinador como para el Ganador del Gran Premio del Viaje, a costa del Ganador.

Si un Ganador del Gran Premio del Viaje elige no llevar acompañante, o si un Acompañante no firma la documentación requerida dentro del plazo especificado en estas reglas oficiales, los elementos del premio relacionados con el Acompañante serán perdidos, y los demás elementos del premio constituirán el cumplimiento total de la obligación del Patrocinador de otorgar el Gran Premio del Viaje.

El Ganador del Gran Premio del Viaje y su Acompañante aceptan cumplir todas las normas y regulaciones del lugar y se comprometen a no comportarse de manera antideportiva o disruptiva.

El Patrocinador determinará, a su entera discreción, la aerolínea y el hotel que se proporcionarán como parte del Gran Premio del Viaje. Todas las fechas de viaje están sujetas a cambios según la entera discreción del Patrocinador.

Si el Ganador del Gran Premio del Viaje o cualquier Acompañante no están disponibles o no pueden viajar en las fechas especificadas por el Patrocinador, los privilegios del Ganador y del Acompañante serán cancelados, y se seleccionará aleatoriamente un ganador alternativo entre las inscripciones elegibles restantes, si el tiempo lo permite.

Pueden aplicarse restricciones, condiciones y limitaciones de viaje. Los arreglos de viaje están sujetos a disponibilidad y deben ser ida y vuelta.

El Ganador del Gran Premio del Viaje y su Acompañante reconocen que deberán firmar un formulario de exención y asunción de riesgos relacionado con su participación en el Viaje.

Al aceptar el Viaje, el Ganador del Gran Premio del Viaje y su Acompañante liberan y acuerdan no demandar a todas las Entidades del Sorteo por daños a propiedad personal o lesiones personales que puedan ocurrir a cualquiera de ellos como resultado de participar en el Viaje.

NOTA: El Gran Premio solo incluye al Ganador del Gran Premio del Viaje y a un (1) Acompañante. Ningún otro invitado del Ganador está incluido.

Si el Ganador del Gran Premio del Viaje elige llevar invitados adicionales, dichos invitados no serán responsabilidad del Patrocinador y ninguno de sus gastos será cubierto por el Patrocinador.

Además, el Ganador del Gran Premio del Viaje reconoce y acepta que todas las cláusulas de indemnización proporcionadas por él al Patrocinador, a las demás Entidades del Sorteo, a las compañías respectivas, afiliadas, subsidiarias, agencias de publicidad/promoción, y a los empleados, directores, funcionarios y agentes de cualquiera de estas organizaciones, se aplicarán también a dichos invitados adicionales, como si fueran el Ganador del Gran Premio del Viaje o el Acompañante.

VALOR APROXIMADO DE TODOS LOS PREMIOS:

EXCLUSIÓN DE ELEGIBILIDAD:
Quedan excluidos de participar en el Sorteo los empleados (excepto aquellos empleados por licenciatarios de la Alliance como técnicos de reparación), directores y funcionarios de Aftermarket Auto Parts Alliance, Inc., sus respectivas afiliadas, subsidiarias, agencias de publicidad/promoción, las demás Entidades del Sorteo, así como los miembros de la familia inmediata de cualquiera de los anteriores (padres, hermanos, hijos y cónyuge) o las personas que convivan en el mismo hogar, estén o no relacionadas, de dichas personas.

CONDICIONES DE PARTICIPACIÓN:

Al participar, el concursante confirma y se responsabiliza de que la dirección proporcionada en su inscripción está actualizada y es válida durante el Período del Sorteo y por seis meses después de finalizado el Sorteo. La dirección del participante debe ser una dirección física; no se aceptarán apartados postales.

Cualquier premio enviado a una dirección incorrecta o que no sea reclamado será perdido y el ganador será descalificado. La elegibilidad de cada ganador será verificada por el miembro del Patrocinador que puso el Sorteo a disposición de dicho ganador. Tras la verificación, el premio será enviado a dicho miembro del Patrocinador, quien notificará al ganador por teléfono, correo electrónico o correo postal y coordinará la entrega del premio.

Si un premio es devuelto como no entregable, el ganador será descalificado y se seleccionará un ganador alternativo de manera aleatoria entre las inscripciones elegibles restantes.

(d) reconoce los peligros y riesgos inherentes asociados con el uso de go-karts, carritos de golf y otros vehículos similares, incluyendo lesiones graves e incluso la pérdida de la vida, y acepta y asume expresamente todos los riesgos, peligros y amenazas que puedan surgir del uso de un vehículo motorizado, los cuales podrían resultar en lesiones personales, pérdida de la vida y daños a la propiedad; y
(e) libera, absuelve, indemniza y acuerda mantener indemne a Aftermarket Auto Parts Alliance, Inc., a las demás Entidades del Sorteo, a las compañías respectivas, afiliadas, subsidiarias, agencias de publicidad/promoción, y a sus empleados, directores, funcionarios y agentes de cualquier responsabilidad por cualquier lesión, pérdida o daño a personas (incluyendo la muerte) y/o a la propiedad de cualquier tipo, causada en todo o en parte, directa o indirectamente, por la participación en el Sorteo, la aceptación, posesión, uso o mal uso del premio, o la participación en cualquier actividad relacionada con el premio, así como por cualquier reclamo, demanda o causa de acción conocida o desconocida, sospechada o no, pasada, presente o futura, en la máxima medida permitida por la ley, sin excepción ni reserva, incluyendo reclamos basados en difamación, derechos de publicidad, invasión de privacidad, infracción de derechos de autor, infracción de marca registrada u otras causas de acción relacionadas con propiedad intelectual.

Al aceptar un premio, el ganador otorga al Patrocinador el derecho de grabar, filmar y fotografiar al ganador (las “Imágenes”). Estas Imágenes serán propiedad del Patrocinador. El Patrocinador y sus designados tendrán el derecho de usar, editar, adaptar, publicar, transmitir, copiar y explotar dichas Imágenes, y todos los elementos que contengan, incluyendo nombre, imagen, voz, conversación y cualquier otro atributo del ganador, individualmente o con otros, junto con su nombre, dirección y cualquier declaración realizada por el ganador sobre el Sorteo o el Patrocinador (siempre que sean verídicas), total o parcialmente, en conjunto con otro material, si lo hubiera, en cualquier medio ahora conocido o que se invente en el futuro, con fines de comercio, publicidad, promoción o cualquier otro propósito legal, de manera perpetua y en todo el mundo, sin compensación adicional, consideración, notificación o permiso, excepto donde la ley lo prohíba.

TÉRMINOS GENERALES

Las Entidades del Sorteo no son responsables si el Sorteo o cualquiera de los eventos incluidos en el Sorteo no pueden realizarse, o si algún premio no puede ser otorgado debido a retrasos, interrupciones o fallas causadas por actos de Dios, guerra, desastres naturales, condiciones climáticas, actos o amenazas de terrorismo, huelgas, cierres patronales, disputas laborales, paros de trabajo, incendios, actos gubernamentales, enfermedades u otros eventos fuera del control razonable de las Entidades del Sorteo.

Si, por cualquier motivo, el Sorteo no puede desarrollarse según lo planeado, incluyendo, sin limitación, infección por virus informático, errores de software, manipulación, intervención no autorizada, fraude, fallas técnicas u otras causas fuera del control razonable de las Entidades del Sorteo, que, a juicio exclusivo del Patrocinador, corrompan o afecten la administración, seguridad, equidad, integridad o correcta realización del Sorteo, el Patrocinador se reserva el derecho, a su entera discreción, de cancelar, terminar, modificar o suspender el Sorteo o cualquier parte del mismo.

Si el Sorteo o alguna parte del Sorteo se termina o modifica antes de la fecha de cierre, se publicará un aviso en https://www.theultimateoutdooradventure.com, si el tiempo lo permite, y los premios serán otorgados a los posibles ganadores seleccionados mediante sorteo aleatorio entre todas las inscripciones elegibles no corrompidas recibidas antes de dicho evento fuera del control razonable del Patrocinador.

El Patrocinador se reserva el derecho de modificar y enmendar estas Reglas Oficiales de vez en cuando durante el Sorteo con fines de clarificación.

CUALQUIER VIOLACIÓN DE ESTAS REGLAS OFICIALES POR PARTE DE UN GANADOR RESULTARÁ EN LA DESCALIFICACIÓN DE DICHO GANADOR Y TODOS LOS PRIVILEGIOS COMO GANADOR SERÁN INMEDIATAMENTE TERMINADOS.

CUALQUIER INTENTO DE CUALQUIER PERSONA DE DAÑAR O SOCAVAR DELIBERADAMENTE el funcionamiento legítimo del Sorteo PUEDE CONSTITUIR UN DELITO O VIOLACIÓN DE LA LEY CIVIL, y en caso de que tal intento ocurra, el Patrocinador se reserva el derecho de buscar remedios y daños (incluidos honorarios de abogados) contra dicha persona en la máxima medida permitida por la ley.

Los tribunales estatales y federales ubicados en el condado de Bexar, Texas, tendrán jurisdicción exclusiva sobre cualquier controversia relacionada con el Sorteo, y las leyes del estado de Texas regirán el Sorteo. ADMISSIBILITÉ

Le tirage au sort Aventure ultime en plein air présenté par Auto Value®/Bumper to Bumper® (« le Tirage au sort ») est offert uniquement aux États-Unis et au Canada et s’adresse uniquement aux personnes qui sont des résidents légaux des États-Unis ou du Canada, âgées d’au moins 21 ans, et qui sont employées dans le secteur de l’après-marché automobile à titre de techniciens en réparation qui achètent ou utilisent des pièces automobiles afin de réparer les véhicules de leurs clients.

PÉRIODE DE PARTICIPATION

Le Tirage au sort débute à 00 h 01, heure normale du Centre (CST), le 1er mars 2026, et se termine à 23 h 59, heure avancée du Centre (CDT), le 30 avril 2026 (la « Période du Tirage au sort »). Aux fins du présent règlement officiel, toutes les heures indiquées font référence à l’heure avancée du Centre ou à l’heure normale du Centre, selon la période de l’année.

Les documents de participation qui ont été altérés ou modifiés sont nuls. L’utilisation de moyens robotisés, automatisés, programmés ou similaires pour participer au Tirage au sort annulera toutes les participations affectées par ces méthodes. Le Commanditaire se réserve le droit, à sa seule discrétion, de disqualifier toute personne qu’il juge, à sa seule discrétion, avoir altéré le processus de participation ou le fonctionnement du Tirage au sort. Une fois soumises, toutes les demandes et participations deviennent la propriété exclusive du Commanditaire et ne feront l’objet d’aucun accusé de réception.

RENSEIGNEMENTS PERSONNELS

En remplissant le formulaire officiel de participation, tous les participants consentent à la collecte, à l’utilisation et à la communication de leurs renseignements personnels par le Commanditaire aux fins de l’administration du Tirage au sort et tel que permis par le présent règlement. Les renseignements personnels désignent toute information permettant d’identifier un participant en tant qu’individu, comme le numéro de téléphone résidentiel, l’âge, l’adresse domiciliaire, l’adresse courriel et le sexe. Le Commanditaire ne vendra ni ne transmettra ces renseignements à des tiers, sauf aux fins de l’administration du présent Tirage au sort.

TIRAGES

Les gagnants seront sélectionnés au moyen de deux (2) tirages au sort parmi toutes les participations admissibles reçues avant 23 h 59 (heure du Centre) la veille de chaque date de tirage. Les tirages seront effectués par le Commanditaire.

Les tirages du Tirage au sort auront lieu le :

  • 1er avril 2026 (Tirage 1)
  • 15 mai 2026 (Tirage 2)

Toutes les participations non sélectionnées comme gagnantes lors du premier tirage seront incluses dans le deuxième tirage.

QUESTION D’HABILETÉ (RÉSIDENTS CANADIENS SEULEMENT)

Au moment d’être avisé de sa sélection pour le Grand Prix du tirage Aventure ultime en plein air, si le participant sélectionné est un résident canadien, il devra répondre correctement, sans aide de quelque nature que ce soit, mécanique ou autre, à une question d’habileté mathématique à durée limitée avant que le prix puisse lui être attribué.

Si le participant sélectionné n’est pas en mesure de répondre correctement à la question d’habileté, le Commanditaire aura le droit de disqualifier ce participant et de tirer au sort une autre participation admissible. Le Commanditaire sera alors entièrement et complètement libéré de toute responsabilité à cet égard.

PRIX ET VALEUR AU DÉTAIL APPROXIMATIVE (VDA)

Un total de vingt (20) gagnants du Grand Prix Voyage (tels que définis ci-dessous) remportera un forfait voyage Aventure ultime en plein air.

La valeur au détail approximative du voyage est de 7 500,00 $ US.

PREMIER PRIX

Un total de dix (10) gagnants du Premier Prix recevront chacun une carte-cadeau VISA de 500 $ US.

  • Cinq (5) gagnants du Premier Prix seront sélectionnés à chaque tirage.

DEUXIÈME PRIX

Un total de quarante (40) gagnants du Deuxième Prix recevront chacun une carte-cadeau VISA de 250 $ US.

  • Vingt (20) gagnants du Deuxième Prix seront sélectionnés à chaque tirage.

TROISIÈME PRIX

Un total de cent (100) gagnants du Troisième Prix recevront chacun une carte-cadeau VISA de 100 $ US.

  • Cinquante (50) gagnants du Troisième Prix seront sélectionnés à chaque tirage.

Les prix ne sont pas attribués sur une base régionale. Les VDA sont sujettes à changement selon les conditions actuelles du marché au moment de l’attribution du prix, du voyage et de la distance entre le point de départ et la destination. Toute différence entre la VDA et la valeur réelle, le cas échéant, ne sera pas attribuée.

Les prix seront attribués sous réserve qu’un nombre suffisant de participations admissibles soit reçu. Les prix sont non transférables; aucun remplacement ni échange contre de l’argent ne sera permis, sauf par le Commanditaire en cas d’indisponibilité du prix, auquel cas un prix de valeur égale ou supérieure sera attribué.

Les gagnants devront signer et retourner une Déclaration d’admissibilité et décharge de responsabilité/publicité (sauf là où la loi l’interdit) dans les 14 jours suivant la tentative d’avis, à défaut de quoi le prix pourra être annulé et un gagnant suppléant pourra être sélectionné au hasard parmi toutes les participations admissibles restantes. La signature électronique sur cette déclaration aura la même valeur légale qu’une signature manuscrite.

Chaque gagnant devra fournir son numéro de sécurité sociale au Commanditaire à des fins fiscales. Les taxes (s’il y a lieu) sur les prix sont la seule responsabilité du gagnant. Les prix sont non transférables et ne peuvent être cédés. Le Commanditaire peut, à sa seule discrétion, substituer un prix de valeur égale ou supérieure si le prix annoncé devient indisponible pour quelque raison que ce soit. Les chances de gagner un prix dépendent du nombre total de participations admissibles reçues au moment du tirage.

GAGNANTS DU GRAND PRIX VOYAGE

Vingt (20) gagnants du Grand Prix Voyage remporteront un forfait voyage du Tirage au sort (le « Voyage ») offert par le Commanditaire.

Le Voyage sera offert au gagnant du Grand Prix Voyage et à un (1) invité, lesquels doivent tous deux (le « Gagnant du Grand Prix Voyage » et l’« Invité », tels que définis ci-dessous) avoir atteint l’âge de 21 ans au moment du Voyage, vers Big Cedar Lodge à Ridgedale, Missouri (la « Destination »). Le gagnant du Grand Prix Voyage est appelé le « Gagnant du Grand Prix Voyage » et son invité, l’« Invité ».

Le Voyage comprend :

  • le transport aérien aller-retour en classe économique pour deux (2) personnes
  • 5 nuits d’hébergement à l’hôtel (cabine à une chambre et taxes d’hébergement désignées par le Commanditaire)
  • certaines activités sélectionnées
  • la participation aux repas et activités organisés par le Commanditaire

Le Gagnant du Grand Prix Voyage et son Invité seront seuls responsables de tous les repas, boissons, transferts terrestres entre le domicile du gagnant et l’aéroport de départ, pourboires, surclassements de voyage, dépenses personnelles et toutes autres dépenses non expressément indiquées aux présentes.

Le Commanditaire se réserve le droit de remplacer le transport aérien par un transport terrestre si le Gagnant du Grand Prix Voyage réside à moins de 100 milles de la Destination. Le Gagnant du Grand Prix Voyage et son Invité doivent voyager selon le même itinéraire.

Le Gagnant du Grand Prix Voyage et son Invité seront responsables d’obtenir, avant le voyage, une pièce d’identité valide émise par le gouvernement américain et/ou tout autre document de voyage requis (le cas échéant), ainsi que d’assumer les coûts liés à ces exigences.

Le Grand Prix Voyage sera attribué sous réserve qu’un nombre suffisant de participations admissibles soit reçu. Le Grand Prix Voyage est non transférable; aucun remplacement ni échange contre de l’argent ne sera permis, sauf par le Commanditaire en cas d’indisponibilité du prix, auquel cas un prix de valeur égale ou supérieure sera attribué.

Le Gagnant du Grand Prix Voyage devra signer et retourner une Déclaration d’admissibilité et décharge de responsabilité/publicité (sauf là où la loi l’interdit), et l’Invité devra signer et retourner une Décharge de responsabilité/publicité (sauf là où la loi l’interdit), dans les 14 jours suivant la tentative d’avis, à défaut de quoi le prix pourra être annulé et un gagnant suppléant pourra être sélectionné au hasard parmi toutes les participations admissibles restantes.

Les Entités du Tirage au sort ne seront pas responsables des annulations, retards, déroutements ou substitutions, ni de tout acte ou omission des transporteurs aériens, hôtels ou autres sociétés de transport, ni de toute autre personne fournissant ces services et hébergements aux passagers, y compris tout résultat en découlant, tel que des modifications de services ou d’hébergement rendues nécessaires par de telles circonstances. Les Entités du Tirage au sort ne seront pas responsables de toute perte ou dommage aux bagages.

Si le Gagnant du Grand Prix Voyage ou l’Invité devient invalide ou ne peut autrement profiter pleinement du forfait Voyage en raison d’une maladie, le Commanditaire aura, à sa seule discrétion, le choix de :

  1. être libéré de son obligation d’attribuer le prix; ou
  2. prolonger la période pendant laquelle ce prix peut être attribué pour une durée déterminée à sa seule discrétion.

Le Gagnant du Grand Prix Voyage ou l’Invité devra prouver cette incapacité au moyen d’un certificat médical, lequel devra être confirmé par un autre médecin acceptable pour le Commanditaire et le Gagnant du Grand Prix Voyage, aux frais du Gagnant du Grand Prix Voyage.

Si un Gagnant du Grand Prix Voyage choisit de ne pas inviter d’Invité, ou si un Invité ne signe pas la documentation prévue au présent règlement dans les délais indiqués, alors les éléments du Grand Prix Voyage liés à l’Invité seront annulés, et les autres éléments du Grand Prix Voyage constitueront l’exécution complète de l’obligation du Commanditaire d’attribuer le Grand Prix Voyage.

Le Gagnant du Grand Prix Voyage et son Invité conviennent de respecter toutes les règles et règlements des lieux visités et conviennent de ne pas adopter de comportement antisportif ou perturbateur.

Le Commanditaire déterminera, à sa seule discrétion, la compagnie aérienne et l’hôtel qui seront fournis dans le cadre du Grand Prix Voyage. Toutes les dates de voyage sont sujettes à changement à la seule discrétion du Commanditaire. Si un Gagnant du Grand Prix Voyage ou un Invité n’est pas disponible ou en mesure de voyager aux dates précisées par le Commanditaire, leurs privilèges seront annulés et un autre Gagnant du Grand Prix Voyage pourra être sélectionné au hasard parmi les participations admissibles restantes, si le temps le permet.

Des restrictions, conditions et limitations de voyage peuvent s’appliquer. Les arrangements de voyage sont soumis à disponibilité et doivent être effectués aller-retour.

Le Gagnant du Grand Prix Voyage et son Invité reconnaissent qu’ils devront signer une renonciation et acceptation des risques concernant leur participation au Voyage. En acceptant le Voyage, le Gagnant du Grand Prix Voyage et son Invité dégagent par les présentes toutes les Entités du Tirage au sort de toute responsabilité et s’engagent à ne pas intenter de poursuite contre elles pour tout dommage matériel ou toute blessure corporelle pouvant survenir à l’un ou l’autre dans le cadre de leur participation au Voyage.

REMARQUE : Le Grand Prix comprend uniquement le Gagnant du Grand Prix Voyage et un (1) Invité. Aucun autre invité du Gagnant du Grand Prix Voyage n’est inclus. Si le Gagnant du Grand Prix Voyage choisit d’amener d’autres invités au Voyage, ces invités supplémentaires ne seront pas sous la responsabilité du Commanditaire et aucune de leurs dépenses ne sera assumée par le Commanditaire.

De plus, le Gagnant du Grand Prix Voyage reconnaît et accepte que toutes les clauses d’indemnisation qu’il accorde au Commanditaire, aux autres Entités du Tirage au sort, aux sociétés respectives, sociétés affiliées, filiales, agences de publicité/promotion, ainsi qu’aux employés, dirigeants, administrateurs et agents de l’une ou l’autre des organisations susmentionnées dans le présent règlement officiel ou dans tout autre document ou entente remis par le Gagnant du Grand Prix Voyage au Commanditaire, s’appliqueront également à ces invités supplémentaires, comme s’ils étaient le Gagnant du Grand Prix Voyage ou l’Invité.

VALEUR AU DÉTAIL APPROXIMATIVE DE TOUS LES PRIX

EXCLUSION DE L’ADMISSIBILITÉ

Les employés (autres que ceux employés par les titulaires de licence de l’Alliance à titre de techniciens en réparation), dirigeants et administrateurs d’Aftermarket Auto Parts Alliance, Inc., de ses sociétés affiliées, filiales, agences de publicité/promotion, des autres Entités du Tirage au sort, ainsi que les membres de la famille immédiate de l’une ou l’autre des personnes susmentionnées (parents, frères et sœurs, enfants et conjoint), ou toute personne vivant sous le même toit, qu’elle soit apparentée ou non, ne sont pas admissibles à participer au Tirage au sort.

CONDITIONS DE PARTICIPATION

En participant, le participant confirme et reconnaît être responsable du fait que l’adresse indiquée sur sa participation est actuelle et valide pendant la Période du Tirage au sort et pour une période de six (6) mois après la fin du Tirage au sort. L’adresse du participant doit être une adresse municipale. Les participations indiquant une case postale ne seront pas acceptées.

Tout prix expédié à une mauvaise adresse ou non réclamé sera annulé et le gagnant sera disqualifié. L’admissibilité de chaque gagnant sera vérifiée par le membre du Commanditaire qui a rendu le Tirage au sort disponible à ce gagnant. Une fois l’admissibilité vérifiée, le prix sera expédié à ce membre du Commanditaire. Ce membre avisera ensuite le gagnant par téléphone, courriel ou courrier et prendra les dispositions nécessaires pour la remise du prix au gagnant.

Les gagnants seront avisés. Si un prix est retourné comme non livrable, le gagnant de ce prix sera disqualifié, et un gagnant suppléant sera sélectionné au hasard parmi les participations admissibles restantes. Chaque gagnant devra signer et retourner une Déclaration d’admissibilité et décharge de responsabilité/publicité (sauf là où la loi l’interdit) dans les 14 jours suivant la tentative d’avis, à défaut de quoi le prix pourra être annulé et un gagnant suppléant pourra être sélectionné au hasard parmi toutes les participations admissibles restantes.

En participant au Tirage au sort, le participant :

  1. accepte d’être lié par le présent règlement officiel, par l’interprétation qu’en fait le Commanditaire et par les décisions du Commanditaire;
  2. reconnaît s’y conformer;
  3. accepte de se conformer à toutes les lois, règles et réglementations fédérales, étatiques/provinciales et locales applicables;
  4. reconnaît les dangers et risques inhérents liés à l’utilisation de go-karts, voiturettes de golf et autres véhicules semblables, y compris les blessures graves et même la perte de vie, et accepte librement et expressément tous les risques, dangers et aléas pouvant découler de l’utilisation d’un véhicule motorisé récréatif pouvant entraîner des blessures corporelles, la perte de vie ou des dommages matériels;
  5. libère, décharge, indemnise et accepte de tenir indemnes à perpétuité Aftermarket Auto Parts Alliance, Inc., les autres Entités du Tirage au sort, les sociétés respectives, sociétés affiliées, filiales, agences de publicité/promotion, ainsi que les employés, dirigeants, administrateurs et agents de l’une ou l’autre des organisations susmentionnées, de toute responsabilité pour toute blessure, perte ou dommage à la personne (y compris le décès) et/ou aux biens de quelque nature que ce soit causés, en tout ou en partie, directement ou indirectement, par la participation au Tirage au sort ou par l’acceptation, la possession, l’utilisation ou la mauvaise utilisation du prix, ou par la participation à toute activité liée au prix, ainsi que pour toute réclamation, demande ou cause d’action connue ou inconnue, soupçonnée ou non, passée, présente ou future, dans toute la mesure permise par la loi et sans exception ni réserve, y compris les réclamations fondées sur la diffamation, les droits à la publicité, l’atteinte à la vie privée, la violation du droit d’auteur, la violation de marque de commerce ou toute autre cause d’action liée à la propriété intellectuelle.

En acceptant un prix, le gagnant accorde au Commanditaire le droit d’enregistrer, de filmer et de photographier ce gagnant (« Images »). Ces Images seront la propriété du Commanditaire. Le Commanditaire et chacun de ses mandataires auront le droit d’utiliser, modifier, adapter, publier, diffuser, copier et exploiter ces Images, ainsi que tous les éléments qu’elles contiennent, y compris tout nom, image, voix, conversation et tout autre attribut du gagnant, seul ou avec d’autres, ainsi que son nom, son adresse et toute déclaration faite par le gagnant au sujet du Tirage au sort ou du Commanditaire (pourvu qu’elles soient véridiques), en tout ou en partie, avec tout autre matériel, le cas échéant, dans tous les médias connus à ce jour ou développés ultérieurement, à des fins commerciales, publicitaires, promotionnelles ou à toute autre fin légale, à perpétuité, dans le monde entier, sans compensation, contrepartie, avis ni permission supplémentaires, sauf là où la loi l’interdit.

CONDITIONS GÉNÉRALES

Les Entités du Tirage au sort ne sont pas responsables si le Tirage au sort ou l’un des événements présentés dans le Tirage au sort ne peut avoir lieu, ou si un prix ne peut être attribué en raison de retards, interruptions ou défaillances dus à des cas de force majeure, guerre, catastrophes naturelles, conditions météorologiques, actes ou menaces de terrorisme, grèves, lock-out, conflits de travail, arrêts de travail, incendie, actes gouvernementaux, maladie ou autres événements échappant au contrôle raisonnable des Entités du Tirage au sort.

Si, pour quelque raison que ce soit, le Tirage au sort ne peut se dérouler comme prévu, y compris, sans s’y limiter, en raison d’une infection par virus informatique, bogues, altération, intervention non autorisée, fraude, défaillances techniques ou toute autre cause échappant au contrôle raisonnable des Entités du Tirage au sort et qui, selon la seule appréciation du Commanditaire, corrompt ou affecte l’administration, la sécurité, l’équité, l’intégrité ou le bon déroulement du Tirage au sort, le Commanditaire se réserve le droit, à sa seule discrétion, d’annuler, de mettre fin, de modifier ou de suspendre le Tirage au sort ou toute partie de celui-ci.

Si le Tirage au sort ou une partie de celui-ci est annulé ou modifié avant la date de clôture, un avis sera affiché sur https://www.theultimateoutdooradventure.com, si le temps le permet, et les prix seront attribués aux gagnants potentiels sélectionnés au hasard parmi toutes les participations admissibles restantes non corrompues reçues avant tout événement échappant au contrôle raisonnable du Commanditaire.

Le Commanditaire se réserve le droit de modifier et d’amender le présent règlement officiel de temps à autre pendant le Tirage au sort à des fins de clarification.

TOUTE VIOLATION DU PRÉSENT RÈGLEMENT OFFICIEL PAR UN GAGNANT ENTRAÎNERA SA DISQUALIFICATION EN TANT QUE GAGNANT DU TIRAGE AU SORT ET TOUS LES PRIVILÈGES LIÉS À CE STATUT SERONT IMMÉDIATEMENT RÉVOQUÉS.

TOUTE TENTATIVE PAR QUICONQUE D’ENDOMMAGER DÉLIBÉRÉMENT OU DE COMPROMETTRE LE FONCTIONNEMENT LÉGITIME DU TIRAGE AU SORT PEUT CONSTITUER UNE VIOLATION DU DROIT CRIMINEL ET CIVIL ET, SI UNE TELLE TENTATIVE EST FAITE, LE COMMANDITAIRE SE RÉSERVE LE DROIT DE RÉCLAMER TOUS RECOURS ET DOMMAGES (Y COMPRIS LES HONORAIRES D’AVOCAT) CONTRE CETTE PERSONNE DANS TOUTE LA MESURE PERMISE PAR LA LOI.

Les tribunaux (étatiques et fédéraux) situés dans le comté de Bexar, Texas, auront compétence exclusive pour toute controverse relative au Tirage au sort, et les lois de l’État du Texas régiront le Tirage au sort. Chaque participant renonce à toute objection relative à la compétence et au lieu de juridiction de ces tribunaux et se soumet par les présentes à leur compétence.

RÉSIDENTS DU QUÉBEC

Tout litige concernant la conduite ou l’organisation du présent concours publicitaire peut être soumis à la Régie des alcools, des courses et des jeux pour décision. Tout litige concernant l’attribution d’un prix peut être soumis à la Régie uniquement dans le but d’aider les parties à parvenir à un règlement.
